Director, Assistant General Counsel - Patents
Capital One’s legal department is looking for a talented, dynamic attorney to influence and lead its patent strategy. The successful candidate must be inquisitive, collaborative, enthusiastic about technology, enjoy problem solving and being continually challenged, and demonstrate excellent judgment even in novel, ambiguous situations.
- Developing strategies and recommendations on patent issues, including the development of the company’s enterprise patent strategy, and presenting these strategies to senior executives;
-Overseeing internal staff supporting Capital One’s patent program, Including a patent attorney and legal assistant;
-Negotiating and drafting patent and other intellectual property terms in strategic transactions such as mergers and acquisitions, assignment and license agreements, vendor agreements, and technology development agreements
-Actively engaging senior business and legal leaders to identify patentable subject matter in the areas they support;
-Directing outside counsel in preparing and prosecuting patent applications; and
-Counseling clients on a wide range of patent issues.
In addition to meeting the qualifications of the role, here’s what else you need to bring:
-Exceptional oral and written communication skills in communicating business and intellectual property issues with, and between, developers, engineers and business leaders.
-Significant experience drafting and prosecuting software and business method patent applications.
-Demonstrated ability to identify effective methods for protecting intellectual property created from software, hardware and internet related products and services.
-Deep understanding of a wide variety of technology areas, particularly payments technologies.
-Ability to work with various teams across the enterprise to advise on patent issues, including technical analysis of software products, education and training of technical teams, and review of technical product features.
-Ability to work independently, while being able to contribute successfully to cross-functional teams
-Excellent organizational skills, with the ability to manage multiple projects at once, and follow through to meet deadlines.
-At least 5 years of experience drafting and prosecuting patent applications OR At least 5 years of combined experience in prosecuting patent applications & patent litigation.
-Juris Doctor and membership in good standing in at least one state bar.
-Registered to practice before the US Patent and Trademark Office (USPTO).
-Bachelor’s degree in Electrical Engineering or Computer Science.
-3 years of experience as an engineer or at least 3 years of experience as a software developer.
